| Atherton Subartesian – Area B | ||
Under section 56 of the Water Resource (Barron) Plan 2002, the owner of existing works which were installed and in use before 20 December 2002 may continue using the works to take groundwater in the Atherton Subartesian Area – Area B, for one year after the commencement of the plan. In order to be authorised to continue to take water after this date, the owner must give notice of the existing works to the chief executive of the Department of Environment and Resource Management in the approved form by Once the owner gives notice of the works, the owner is authorised to continue to use the works to take groundwater until the owner is granted a water licence. | Water Resource (Baffle Creek) Plan 2010 area | ||
Under sections 51 and 52 of the Water Resource (Baffle Creek) Plan 2010, the owner of existing works is authorised to continue using the works to take overland flow water, for one year after the commencement of the plan. For this authority to be continued the owner must give notice of the works to the chief executive of the Department of Environment and Resource Management in the approved form by 5.00pm 5 November 2011. If the owner gives notice of the works by this date, the owner may continue to use the works that take overland flow water until the owner is granted a water licence. Notification is not required for existing works taking overland flow water that have a capacity of not more than 20 ML. Note: works that take overland flow for stock or domestic purposes must also be notified. An indicative map (PDF, 80K)* shows the boundary area. | Water Resource (Cooper Creek) Plan 2011 area | ||
Under section 37 of the Water Resource (Cooper Creek) Plan 2011, the owner of existing works is authorised to continue using the works to take overland flow water, for one year after the commencement of the plan. For this authority to be continued the owner must give notice of the works to the chief executive of the Department of Environment and Resource Management in the approved form by 5.00pm 14 November 2012. If the owner gives notice of the works by this date, the owner may continue to use the works that take overland flow water or until the owner is granted a water licence under section 38 of the water resource plan. Notification is not required for existing works taking overland flow water that have a capacity of not more than 10 ML, or works that take overland flow water solely for stock or domestic purposes. Overland flow—Landholders Under section 111 of the Water Resource (Fitzroy Basin) Plan 2011 an owner of land in the Fitzroy Basin with existing overland flow works in existence before 13 September 2001 should provide the chief executive with a notice of works. Landholders who notified under the previous water resource plan do not need to renotify their works. Notification is not required for existing overland flow works that:

Overland flow—Holders of mining tenements and petroleum tenures Under section 111 of the Water Resource (Fitzroy Basin) Plan 2011 the holder of a mining tenement or petroleum tenure for land with overland flow works in existence before the commencement of this plan, should provide the chief executive with a notice of works. Notification is not required for existing overland flow works that were authorised to take overland flow water for activities authorised under the mining tenement or petroleum tenure under the Environmental Protection Act 1994. Failure to notify of works could result in the unauthorised take of overland flow water. Under section 49I of the Water Resource (Pioneer Valley) Plan 2002 as amended October 2009, the owner of existing works is authorised to continue using the works to take groundwater for a purpose other than stock or domestic, for 60 business days after the commencement of the plan. For this authority to be continued the owner must give notice of the works to the chief executive of the Department of Environment and Resource Management in the approved form by 5.00pm Wednesday 6 January 2010. If the owner gives notice of the works by this date, the owner may continue to use the works that take groundwater until the owner is granted a water licence or a water allocation. Under section 68 and 73 of the Water Resource (Whitsunday) Plan 2010, the owner of existing works is authorised to continue using the works to take groundwater or overland flow water, for one year after the commencement of the plan. Notification is not required for existing works to take groundwater for stock or domestic purposes. Notification is not required for existing works taking overland flow water:
