Notice of works forms

Use this form to notify the department of existing works that take overland flow water. Note: works that take overland flow and are used solely for stock or domestic purposes generally do NOT require notification.

Under section 56 of the Water Resource (Barron) Plan 2002, the owner of existing works which were installed and in use before 20 December 2002 may continue using the works to take groundwater in the Atherton Subartesian Area – Area B, for one year after the commencement of the plan.

In order to be authorised to continue to take water after this date, the owner must give notice of the existing works to the chief executive of the Department of Environment and Resource Management in the approved form by
4.30pm Monday 29 November 2010.

Once the owner gives notice of the works, the owner is authorised to continue to use the works to take groundwater until the owner is granted a water licence.

Notice of works - Burdekin River (downstream of Warren's Gully) (PDF, 69K)*

Use this form to notify the department of works that take water from the Burdekin River (downstream of Warren's Gully), including the anabranch, and that were constructed prior to 1 January 1988. Notification is only required if the owner currently does not hold a water entitlement to take water through the works.

Use these forms to continue using existing works for the taking of groundwater in the Einasleigh Groundwater Management Area (in the Gulf Water Resource Plan area) and the Chillagoe Groundwater Management Area (in the Mitchell Water Resource Plan area). This form is in two parts.

Following a recent amendment to the Water Regulation 2002, owners of land are now required to notify the department, before 5:00 pm on 28 August 2009, about existing subartesian bores and associated water use from land in Implementation Area 2A (AP14824) of the Lockyer Valley groundwater management area. The form is in several parts.

The Water Regulation 2002 amended on 7 November 2008 required that land owners and lessees in the Pioneer Valley Watercourse Area notify the chief executive about works that take or interfere with groundwater on their property by 8 January 2009.

Under sections 51 and 52 of the Water Resource (Baffle Creek) Plan 2010, the owner of existing works is authorised to continue using the works to take overland flow water, for one year after the commencement of the plan.

For this authority to be continued the owner must give notice of the works to the chief executive of the Department of Environment and Resource Management in the approved form by 5.00pm 5 November 2011.

If the owner gives notice of the works by this date, the owner may continue to use the works that take overland flow water until the owner is granted a water licence.

Notification is not required for existing works taking overland flow water that have a capacity of not more than 20 ML. Note: works that take overland flow for stock or domestic purposes must also be notified.

Under section 37 of the Water Resource (Cooper Creek) Plan 2011, the owner of existing works is authorised to continue using the works to take overland flow water, for one year after the commencement of the plan.

For this authority to be continued the owner must give notice of the works to the chief executive of the Department of Environment and Resource Management in the approved form by 5.00pm 14 November 2012.

If the owner gives notice of the works by this date, the owner may continue to use the works that take overland flow water or until the owner is granted a water licence under section 38 of the water resource plan.

Notification is not required for existing works taking overland flow water that have a capacity of not more than 10 ML, or works that take overland flow water solely for stock or domestic purposes.

Groundwater

Under section 124 of the Water Resource (Fitzroy Basin) Plan 2011 an owner of prescribed existing groundwater works in the following areas should provide the chief executive with a notice of works by completing form W2F109 Notice of works—groundwater Water Resource (Fitzroy Basin) Plan area (PDF, 64K)*:

• Isaac Connors Groundwater Unit 1 in the Isaac Connors groundwater notification area and the works were in existence on 15 December 2006
• Isaac Connors Groundwater Unit 2 in the Isaac Connors groundwater notification area and the works were in existence on 14 December 2010
• Callide groundwater notification area and the works were in existence on 14 December 2010.

Notification is not required for existing works which take groundwater for only stock or domestic purposes. 

Failure to notify of works could result in the unauthorised take of groundwater.

Overland flow—Landholders

Under section 111 of the Water Resource (Fitzroy Basin) Plan 2011 an owner of land in the Fitzroy Basin with existing overland flow works in existence before 13 September 2001 should provide the chief executive with a notice of works.

Landholders who notified under the previous water resource plan do not need to renotify their works.

Notification is not required for existing overland flow works that:

• take water for only stock or domestic purposes
• are less than 5 ML and situated in the Downstream Fitzroy Barrage sub-catchment
• are less than 50 ML and situated in the remainder of Fitzroy Basin.

Failure to notify of works could result in the unauthorised take of overland flow water.

Overland flow—Holders of mining tenements and petroleum tenures 

Under section 111 of the Water Resource (Fitzroy Basin) Plan 2011 the holder of a mining tenement or petroleum tenure for land with overland flow works in existence before the commencement of this plan, should provide the chief executive with a notice of works. 

Notification is not required for existing overland flow works that were authorised to take overland flow water for activities authorised under the mining tenement or petroleum tenure under the Environmental Protection Act 1994. 

Failure to notify of works could result in the unauthorised take of overland flow water.

Under section 49I of the Water Resource (Pioneer Valley) Plan 2002 as amended October 2009, the owner of existing works is authorised to continue using the works to take groundwater for a purpose other than stock or domestic, for 60 business days after the commencement of the plan.

For this authority to be continued the owner must give notice of the works to the chief executive of the Department of Environment and Resource Management in the approved form by 5.00pm Wednesday 6 January 2010.

If the owner gives notice of the works by this date, the owner may continue to use the works that take groundwater until the owner is granted a water licence or a water allocation.

Under section 68 and 73 of the Water Resource (Whitsunday) Plan 2010, the owner of existing works is authorised to continue using the works to take groundwater or overland flow water, for one year after the commencement of the plan.

Notification is not required for existing works to take groundwater for stock or domestic purposes.

Notification is not required for existing works taking overland flow water:

• for stock or domestic purposes, or
• that have a capacity of not more than 20 ML, or
• of not more than the amount necessary to satisfy the requirements of:
  • an environmental authority issued under the Environmental Protection Act 1994 (Qld), or
  • a development permit for carrying out an environmentally relevant activity, under the Environmental Protection Act 1994 (Qld).

For this authority to be continued the owner must give notice of the works to the chief executive of the Department of Environment and Resource Management in the approved form by 5.00pm 26 February 2011.

If the owner gives notice of the works by this date, the owner may continue to use the works that take overland flow water or groundwater until the owner is granted a water licence.
