RESTRICTIVE TRADE PRACTICES COMPLIANCE - ADR/2005/2333
The Competition Policy Reform (Queensland) Act 1996 makes Queensland Government agencies subject to the restrictive trade practices laws in Part IV of the Trade Practices Act 1974 (Cth), where the agency is carrying on a business. When an agency is carrying on a business it must ensure that its behavious does not contravene the restrictive trade practices laws. Agencies are not considered to be carrying out certain activities, (i.e. conducting regulatory activities or acting under a statutory authority), or in certain transactions (i.e. where all parties affected are agencies of the Queensland Government).
